Förevarande uppsats syftar till att analysera godtagbarheten av en kriminali-sering av rymning från fängelse i svensk rätt. I den större delen av uppsatsen analyseras godtagbarheten utifrån de fem kriterier som satts upp i SOU 2013:38 Vad bör straffas? (Straffrättsutredningen).
